This Privacy Policy (“Privacy Policy”) constitutes a binding agreement between you and Evy Planner Inc. (“Company,” “we” or “us”).  By using our platform or application to plan an event as a visitor or registered user (collectively, the “Service”), or by clicking your acceptance to our Privacy Policy, you agree to be bound by this Privacy Policy and our Terms of Service available at:, which are incorporated herein by reference.  If you do not agree with this Privacy Policy or our Terms of Service, you must not use or access our Service.

If you register for our Service as a user, you will be registering as a Planner, Client, or Vendor.  As such, you will need to provide certain information to us, including personally identifiable information, in order for us to provide our Service.  This Privacy Policy describes the types of information we may collect from you or that you may provide to us when you use our Service and our practices for collecting, using, maintaining, protecting, and disclosing that information.  Below are the sections of our Privacy Policy for your convenience.

  1. Changes to Our Privacy Policy

We may at times amend this Privacy Policy, which we reserve the right to do any time at our sole discretion.  We will make the amended Privacy Policy available through our Service, or we may choose to notify you of any major substantive changes by sending you an e-mail.  You are responsible for making sure that the e-mail address we have for you is accurate and can receive messages from us.  You are also responsible for periodically checking our Privacy Policy to see if it has been amended at all.  The date this Privacy Policy was last revised is set forth at the top.  Your continued use of our Service following any such amendments constitutes your consent to follow and be bound by this Privacy Policy, as amended.

  1. Information We Collect

Information we collect about you when you use our Service can be: (i) Personal Information; or (ii) Anonymous Information.  “Personal Information” is any information that could reasonably be used to identify you or another person, and “Anonymous Information” is information that cannot be used to identify you or any other individual personally such as, for example, general demographic information.

We may collect Personal Information in the ways described below.  Please note that if you do not provide certain Personal Information to us when requested, you may not be able to access or use certain features of our Service if that information is needed for a particular feature.

Information Provided By You as a Registered User

When you register to become a user of our Service and plan an event, you will need to provide Personal Information, which will include your: (i) first name; (ii) last name; and (iii) e-mail address.  You may register directly with our Service and provide the following Personal Information.  In other instances, you may be invited to register by another user in which case you may have to provide the same Personal Information to register and use our Service.

For certain other users we may also collect the following information: (i) company name; (ii) company website; (iii) company address; (iv) company phone number; (v) credit card information; and (vi) billing address.

As a Client or Planner, you will also be providing through our Service information that may include Personal Information of others such as each of your guest’s: (i) first name; (ii) last name; (iii) email address; (iv) phone number; (v) relationship to Client; and (vi) and mailing address.  If you provide such Personal Information of guests to us, you represent and warrant to us that you have the permission and right to provide such information to us for purposes of planning your event.

As a user you may also be providing through our Service information about the event that is being planned with our Service.  This information can include the event details such as the date, time, and location of the event, event costs, event budgets, guest lists, table lists, and payments made.  As such, this information could include Personal Information in certain contexts or Anonymous Information at other times.

You may also provide us with Personal Information other ways such as when you send us an e-mail, post any content in our Service, submit information or answers through comment forms or text boxes in our Service, or send messages to other users through our Service.

Information We Collect Through Automatic Data Collection Technologies

In addition to information you provide to us voluntarily as a user, as you use our Service, we may use automatic data collection technologies, such as cookies, to collect certain information about your interaction with our Service, which in large part will be Anonymous Information such as: (i) your use of our Service in terms of pages or screens of the application that you visit or view; (ii) actions you take on certain pages or screens; (iii) general demographic information; or (iv) information about your computing device (e.g., desktop or mobile), operating system, and browser type.  (See section below regarding Aggregated and Anonymized Information).

By using our Service, you consent to our use of automatic data collection and tracking technologies as described in this Privacy Policy.  The types of technologies we may use include cookies.  A cookie is a small text file placed on the hard drive of your computer or device by our Service.  You can choose to not accept cookies by adjusting your browser or device settings.  However, if you do so, you may be unable to access certain parts of our Service or lose some of the functionality of our Service.  Unless you have set your browser or device not to accept cookies, our Service will issue cookies to your device.  Some features of our Service may use certain cookies to collect and store information about your preferences and navigation to, from, and on our Service.

  1. How We Use and Share Information We Collect

We use information we collect about our users and others, including Personal Information, for the following purposes:

We do not sell your Personal Information to third parties for purposes of advertising, soliciting, or telemarketing.  As noted in Section 6 below, we may share aggregated or anonymous information about our users, and other information that does not identify any particular individual, without restriction.  With regard to Personal Information we collect or that you provide, we may disclose such information as described in this Privacy Policy, including:

  1. Your Choices Regarding Your Information

We provide you with choices regarding your Personal Information that you provide to us.  Our Service has certain features to provide you with control over your information, namely:

Opt-out:  As noted above, we may send communications to you about our own or third-parties’ goods and services that may be of interest to you or relevant to the event you are planning through our Service.  If you do not wish to receive such marketing communications from us, you will be able to opt-out of such emails by changing your preferences in your account or by following the instructions for opting-out that appear at the bottom of our marketing emails.  Please note, however, that you will not be able to opt-out of certain communications we must send to you in order to provide our Service such as emails confirming transactions, emails notifying you about changes to our Service, or emails regarding changes to the event you are planning using our Service.  In addition, even if you opt-out of our marketing emails, we may still have to use and share your Personal Information as permitted by this Privacy Policy or as may be required by law.  Subject to the terms of our Privacy Policy, we will take commercially reasonable efforts to process your opt-out requests within 48 to 72 hours of our receipt of the same.

Account Information:  You will be permitted to access your account (with an established user name and password) in order to change information you have provided in your account or even delete your account.  For example, you will be able to change your email address, phone number(s), or mailing address.  Please note, if you delete your account or any Personal Information that is necessary for us to provide our Service to you, then we may not be able to continue to provide our Service to you or other users who may be involved in the planning of your event such as a Planner.    In some instances, it might be impossible for us to delete all of your information completely because of data backups and records of deletions.  

In addition, if you request deletion of your account or any Personal Information, we will take reasonable steps to verify your identity which may include requiring you to supply government or other identification or verifying your name, e-mail address, or other account information.  We may also not accommodate a request to delete or change information if we cannot verify your identity or if we believe the change would violate any law or legal requirement or cause the information to be incorrect.  Also, certain of your information may be exempt from deletion requests in some circumstances such as if we need to keep processing your information for our legitimate interests, to comply with legal obligations, or if we need to investigate fraud or other issues in connection with our Service.

Regarding any aggregated and anonymized information as described in Section 6 below, you will not be able to request any changes to or deletion of any de-identified, anonymous, or aggregated data from our databases.

  1. Aggregated and Anonymized Information

We may at times aggregate or anonymize (e.g., de-identify) any information collected through our Service.  Such anonymized information will no longer be able to be used to identify you or any other user or individual.  We may therefore use such aggregated or anonymized information for any purpose, including but not limited to, for our own research and marketing purposes, or for sharing with any third parties at our discretion, such as promotional sponsors or potential partners.

  1. Our Community-Based Features

Our Service offers some community-based features which will permit you to interact with other users such as by engaging in conversations with other users, starting or joining community-based discussions, posting content, suggesting a new community (which will require pre-approval by us), and liking and un-liking posts by other users.  Please note that any information you provide or post through our community-based features may be read, collected, and used by others who have access to them.  We do not have an obligation to monitor the content of messages sent using our Service or community-based features, however, we reserve the right to do so in our discretion and to make sure any content complies with our Terms of Service.  Please be cautious about any information you submit in our community-based features.  For example, do not post any personal information you do not want others to see or you may choose to use a username that does not disclose your personal identity.  Please also be advised that if you do post or share anything in our community-based features, it may be impossible for us or you to remove all instances of the same, for example, if someone else has taken a screenshot of your posting.

  1. Third-Party Links

Our Service may contain links to other third-party apps, websites, or services (“Third-Party Services”).  Please be advised that our Privacy Policy does not govern or control these Third-Party Services in any way or the privacy practices of such Third-Party Services.  Should you visit any of these Third-Party Services by clicking a link to them on our Service, the privacy policies of these Third-Party Services will govern the collection and use of your information.  We are therefore not responsible for these Third-Party Services’ privacy practices or any of the content or information provided through their services.  We therefore encourage you to read the privacy policy of any Third-Party Service to see how they will handle your information.

  1. Children’s Privacy

Our Service is not intended for use by anyone under the age of 13, and in fact, is not intended for use by minors under the age of 18.  If we become aware that anyone under age 13 has submitted Personal Information to us as defined in the U.S. Children’s Online Privacy Protection Act without valid parental consent, we will take reasonable steps to delete it as soon as possible.  We also do not knowingly collect or process data from EEA residents under the age of 16 without parental consent.  If we become aware that any EEA resident under the age of 16 has submitted Personal Information to us, we will take reasonable steps to delete it as soon as possible.

  1. Data Security and Retention

We use a variety of technical, physical, and administrative measures intended to keep your Personal Information secure from accidental loss and from unauthorized access, use, alteration, and/or disclosure.  For example, we use Secure Sockets Layer (“SSL”) throughout our Service to establish encrypted connections and access to accounts requires passwords and/or two-factor authentication.  In addition, all information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your Personal Information also largely depends on you as a user of our Service.  Because our Service requires registered users to create unique identifiers such as their user ID and password, you are responsible for keeping your user ID and password information confidential.  You should not therefore share your user ID or password information with anyone.  We are not responsible for any loss of information caused by our users’ failure to maintain the confidentiality of their user ID and/or password.  

If our Service permits you to post information in areas accessible or viewable by other users, or if it permits you to message other users such as event Planners or event Vendors, we urge you to be careful about the information you post in such areas or information you provide in such messages.  You should also avoid sharing computers or devices that you use to access our Service and be sure to log off the Service when you are not using it.

Unfortunately, the transmission of information over the Internet is not completely secure at all times.  Although we do our best to protect your Personal Information, we cannot guarantee the security of such Personal Information transmitted through our Service at all times.  You therefore acknowledge that any transmission of such information is completely at your own risk.  We are not responsible for the circumvention of any privacy settings or security measures contained in our Service.

We will retain your information for as long as your account is active or as needed to provide you with our Service.  If you no longer want to use our Service, you may close your account.  However, after closing your account, we may need to retain and use your information, including Personal Information, as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

  1. Privacy for California Residents

Under California’s Consumer Privacy Protection Act (“CCPA”), we are required to provide California residents certain disclosures about their CCPA privacy rights in connection with their Personal Information.

Right to Know:  Under the CCPA, as a California resident you have the right to be informed about: (1) the categories of personal information we collect or disclose about you; (2) the categories of sources of such information; (3) the business or commercial purpose for collecting your Personal Information; and (4) the categories of third parties with whom we share your Personal Information.

Below are the categories of information required to be disclosed by the CCPA, and whether we have collected such information in the last twelve months through our Service is indicated by a “Yes” or “No.”




A. Identifiers.

Name, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, driver's license number, or other similar identifiers.


B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

A name, signature, address, telephone number, passport number, bank account number, credit card number, debit card number, or any other financial information.

Some personal information included in this category may overlap with other categories.


C. Protected classification characteristics under California or federal law.

Age (40 years or older), marital status, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions).


D. Commercial information.

Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.


E. Biometric information.

Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans.


F. Internet or other similar network activity.

Browsing history, search history, information on a consumer's interaction with an application.


G. Geolocation data.

Physical location or movements.


H. Sensory data.

Audio, electronic, visual, thermal, olfactory, or similar information.


I. Professional or employment-related information.

Current or past job history or performance evaluations.


J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)).

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.


K. Inferences drawn from other personal information.

Profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.


We collect the above information directly from our users.  To understand the business or commercial purposes for collecting the above information and the categories of third parties with whom we share your Personal Information please see Section 4 of our Privacy Policy above regarding How We Use and Share Information We Collect.  And below are additional rights under the CCPA you have as a California resident:

Right to Access:  Under the CCPA, we must also provide you with access to and/or a copy of certain of your Personal Information we hold.

Right to Delete: Under the CCPA, you have the right to request deletion of certain Personal Information we have about you.

Right to Opt-Out:  If we were to “sell” any of your Personal Information as the term “sale” is defined under the CCPA, as a California resident you have the right to opt-out of the “sale” of your Personal Information.  The CCPA broadly defines “sale” in a manner that could include our sharing of your Personal Information with third parties to provide you with offers or promotions that may be of interest to you, or it may include allowing third parties to receive certain information such as your browsing behavior to deliver targeted advertising on our Service.  If we were to “sell” such information for those purposes and you wish to opt-out of that, you may e-mail us at the e-mail address in the “Contact Us” section below.

If you contact us to opt-out or exercise any of your CCPA rights, we will confirm receipt of your request and will provide you with information about the Personal Information we hold about you.  Please note that before responding to any of your CCPA requests, we will take reasonable steps to verify your identity which may include requiring you to supply government or other identification or verifying your name, e-mail address, or other account information.  If we are unable to verify your identity, we may, at our discretion, deny your CCPA request.  You may designate an authorized agent to make a CCPA request on your behalf.  In order to do that, you must provide a valid power of attorney, the requester’s valid government issued identification, and the authorized agent’s valid government issued identification.  We may also follow-up with you to verify your identity before processing an authorized agent’s request.

Please be advised that some information may be exempt from a CCPA request.  For example, we need certain information from you in order to provide our Service to you and if you wish to continue to use our Service, we cannot delete all of your account information.

We will not discriminate against you for exercising any of your CCPA rights, including denying you goods or services, providing you with a different level or quality of services, or charging you different prices or rates for services.

  1. Notice to International Users

Since we are located in the United States of America, your Personal Information will be collected and processed in the United States.  Therefore, if you are located outside the United States and use our Service, your information will be transferred to the United States, which has its own privacy laws regarding data protection.  Please note that the laws and regulations in the United States regarding protection of your Personal Information may not be the same as those in the country where you live.  Therefore, if you do not wish for your Personal Information to be collected and processed in the United States, your only choice is to not use our Service.

We may at times use subcontractors to process your Personal Information or share your Personal Information with business partners located in countries other than your country of residence.  Such third parties may be engaged in the provision of services to us or you, the processing of transactions or provision of support services.  By providing your Personal Information to us, you acknowledge and agree to such transfer, storage, or use.

If you live in the EEA, if we provide any of your Personal Information to any non-EEA third parties, we will take appropriate measures to ensure that such third parties protect your information adequately in accordance with this Privacy Policy.  These measures include signing agreements in accordance with EU and other data protection laws to govern the transfer of such data.
